East Gate acts primarily as a sourcing and import intermediary and does not manufacture the goods sourced unless expressly stated otherwise in writing.
Where goods are obtained from third-party suppliers, manufacturers or vendors, those parties remain responsible for the manufacture, quality, specifications, quantity, authenticity and conformity of the goods supplied.
02Sourcing Fee
A JMD $3,000 sourcing fee applies to sourcing services unless a different fee is expressly agreed upon in writing.
The sourcing fee covers the work involved in sourcing and may include supplier research, locating products, contacting suppliers, requesting quotations, comparing supplier options, negotiating where applicable, communicating product requirements, coordinating supplier information and other administrative work associated with the sourcing process.
The sourcing fee is non-refundable.
Once East Gate has commenced sourcing work, the JMD $3,000 sourcing fee is non-refundable, including where the Customer subsequently decides not to proceed with the purchase.
The sourcing fee is separate from the cost of goods, shipping, customs duties, taxes, inspection fees, storage charges and other applicable costs.
Payment of the sourcing fee does not guarantee that the Customer will ultimately purchase goods or that a supplier will accept an order.
03Supplier Selection
East Gate may identify suppliers based on availability, pricing, product specifications, supplier responses, previous sourcing experience or other commercial considerations.
The Customer acknowledges that suppliers are independent third parties.
East Gate does not represent that every supplier is infallible or that a supplier will always perform exactly as expected.
Where reasonably possible, East Gate will communicate relevant supplier information and assist the Customer in evaluating the available options.
The final decision to proceed with an order rests with the Customer.
04Quotations and Pricing
Supplier prices and quotations may change at any time before an order is finalized.
A quotation provided by East Gate may be based on information supplied by a third-party supplier and may be subject to confirmation.
Prices may change because of supplier price changes, currency fluctuations, product specification changes, quantity changes, weight or dimensional changes, freight-rate changes, customs charges, inspection charges, government fees, taxes and duties, port or warehouse charges, or other third-party charges.
Unless expressly stated otherwise in writing, quotations are estimates and are not guaranteed until the applicable order and payment have been confirmed.
The Customer is responsible for the final amount applicable to the transaction.
05Currency
Transactions may be quoted or charged in Jamaican Dollars (JMD), United States Dollars (USD), or another currency agreed upon for the particular transaction.
Where currency conversion is required, the applicable conversion rate or converted amount will be communicated to the Customer where reasonably practicable.
The Customer is responsible for any difference resulting from currency fluctuations, conversion charges or payment-provider charges.
06Deposits and Supplier Payment Requirements
Deposit requirements and payment schedules are determined according to the requirements of the applicable supplier and the specific transaction.
Depending on the order, the supplier may require a deposit, partial payment, full payment, payment before production, payment before dispatch, or another payment arrangement.
The Customer agrees to provide all funds required within the timeframe communicated by East Gate.
Full payment required by the supplier must be completed before goods are shipped from China.
East Gate will not be responsible for delays, cancellation, additional costs, supplier penalties or loss of supplier deposits resulting from the Customer's failure to provide required funds on time.
07Customer Approval of Orders
The Customer is responsible for carefully reviewing all information relating to an order before authorizing East Gate to proceed.
This may include product description, product photographs, quantity, size, colour, material, measurements, model, product specifications, branding, logo requirements, packaging, supplier quotation, price, shipping method and other relevant requirements.
Once the Customer approves or authorizes an order, East Gate may proceed with the supplier.
The Customer is responsible for ensuring that all information and instructions provided to East Gate are accurate and complete.
08Changes to Orders
Once an order has been submitted to a supplier, changes may not be possible.
Where a change is possible, the supplier may impose additional charges, production delays, cancellation charges or other costs.
The Customer is responsible for any additional cost resulting from a requested change after an order has been submitted.
East Gate does not guarantee that a supplier will agree to modify an order.
09No Direct Refunds from East Gate
East Gate Sourcing & Importing does not provide refunds from its own funds for goods, products or transactions purchased or arranged through third-party suppliers.
East Gate is a sourcing and import intermediary and is not the manufacturer or supplier of third-party goods unless expressly stated otherwise in writing.
If the Customer reports that goods are defective, incorrect, incomplete, damaged, different from the requested specifications, unavailable, delayed or otherwise unsatisfactory, East Gate may assist the Customer in communicating with the relevant supplier and submitting a claim.
East Gate does not guarantee the result of any supplier claim.
Any refund, replacement, credit, reimbursement or other remedy relating to the goods is dependent upon the decision and policies of the applicable supplier or other responsible third party.
East Gate does not guarantee, promise or undertake to provide a refund, replacement, credit or compensation to the Customer for a supplier-related issue.
East Gate will not advance, substitute, reimburse or pay its own funds to the Customer in place of a supplier refund.
If a supplier independently approves and actually sends a refund to East Gate for the Customer, East Gate will forward the amount actually received from the supplier to the Customer, less any applicable third-party charges or costs properly incurred in connection with the transaction or recovery.
Payment made to East Gate does not constitute a guarantee by East Gate of the quality, performance, suitability, durability, condition or accuracy of third-party goods.
10Supplier Errors, Defects and Inaccuracies
East Gate does not manufacture the goods sourced from third-party suppliers and therefore does not control the supplier's manufacturing or fulfillment process.
East Gate does not guarantee that goods supplied by a third party will be identical to online photographs, identical to samples, free from manufacturing defects, the exact colour shown on a screen, the exact shade shown in photographs, the exact material represented by the supplier, the exact measurements stated by the supplier, completely free from minor variations, free from supplier substitutions, or otherwise exactly as expected by the Customer.
Where a supplier provides goods that are different, inaccurate, defective, incomplete or otherwise inconsistent with the approved order, East Gate may assist the Customer in communicating with the supplier.
However, the outcome of the matter is determined by the supplier or other responsible third party.
East Gate shall not be responsible for replacing or reimbursing the Customer for goods due solely to a supplier's error, defect, substitution, shortage or inaccurate fulfillment.
11Supplier Claims
Where a supplier allows a claim, East Gate may assist with submitting information, photographs, documentation or other evidence required by the supplier.
The Customer agrees to provide any information reasonably required to support a claim.
Any refund, replacement, credit or compensation is subject to the supplier's decision and applicable supplier policies.
East Gate does not guarantee that a supplier will approve a claim.
East Gate's assistance with a claim does not constitute an admission of liability by East Gate.
12No Returns to East Gate
East Gate is a sourcing, importing and forwarding service and does not operate as a retail store or manufacturer.
Goods sourced through East Gate are not returnable to East Gate.
A Customer may not return goods to East Gate because they changed their mind, no longer want the goods, ordered the wrong size, selected the wrong colour, ordered the wrong quantity, their business requirements changed, they are dissatisfied with the product, the product did not meet their personal expectations, or they otherwise no longer wish to keep the goods.
Where a supplier accepts a return, the Customer remains responsible for any applicable return shipping, supplier fees, handling fees and other costs.
East Gate does not guarantee that a supplier will accept a return.
13Shipping Services
East Gate may arrange:
- AIR FREIGHT: generally intended for goods requiring faster transportation and may be charged according to applicable weight, volumetric weight, dimensions and other carrier requirements.
- SEA FREIGHT: may be used for larger, heavier or bulkier shipments and may be calculated based on applicable volume, cubic measurement, weight or other freight requirements.
The applicable shipping method and pricing will be communicated to the Customer for the particular transaction.
14Shipping Estimates
Any shipping or transit timeframe provided by East Gate is an estimate and not a guaranteed delivery date.
Transit times may be affected by supplier production, supplier dispatch, warehouse processing, freight availability, airline schedules, shipping-line schedules, port congestion, customs processing, customs examinations, government action, weather, natural disasters, strikes, labour disputes, transportation disruptions, security events, incorrect Customer information, missing documentation, or other circumstances outside East Gate's reasonable control.
The Customer acknowledges that international shipping involves circumstances that East Gate does not control.
15Customs Clearance
East Gate may coordinate customs clearance for goods entering Jamaica.
Customs authorities have independent authority to inspect goods, examine goods, value goods, classify goods, detain goods, request documentation, assess duties and taxes, seize goods, or take other action permitted by law.
East Gate cannot guarantee the outcome of any customs assessment or examination.
16Customs Duties, Taxes and Government Charges
All applicable customs duties, taxes, government charges, inspection fees, examination fees and other import-related charges are the Customer's responsibility.
East Gate may arrange or facilitate payment or clearance where applicable, but the underlying responsibility for applicable import charges remains with the Customer.
Any customs estimate provided by East Gate is an estimate unless expressly confirmed by the relevant authority. The final amount assessed by customs or another competent authority may differ from any initial estimate.
Inbound Clearance Fee
The inbound clearance fee is an additional charge applied to packages to cover the cost of clearance duties. Rather than processing each package individually, we clear shipments by container or consolidated shipment.
Because clearance is handled in bulk, individual C-numbers or receipts are not issued to customers. The fees paid cover the entire container or shipment, and the cost allocated to each customer is calculated as a percentage of the declared value of their goods.
This method allows us to distribute the overall clearance cost across the shipment, making it more cost-effective for customers than having each package processed individually by customs.
Please note that the inbound clearance fee is separate from the regular shipping fee.
17Customer Documentation
The Customer is responsible for providing accurate information and documentation required for sourcing, purchasing, shipping and customs clearance.
This may include full legal name, contact information, identification, invoices, product descriptions, product values, quantity, intended use, import information, shipping details and other documents reasonably requested.
The Customer is responsible for ensuring that information supplied to East Gate is truthful, complete and accurate.
East Gate is not responsible for consequences resulting from incorrect, incomplete, misleading or fraudulent information supplied by the Customer.
18Prohibited Goods
East Gate does not knowingly source or ship illegal goods.
East Gate specifically does not ship illegal weapons, firearms or prohibited weaponry, illegal drugs, controlled substances, or other goods prohibited by applicable law.
East Gate may refuse any order or shipment that it reasonably believes violates applicable law, customs requirements, carrier policies or these Terms.
If prohibited, restricted or undeclared goods are discovered, the Customer may be responsible for resulting costs, penalties, seizure, storage, legal consequences and third-party charges to the extent applicable.
19Customs Seizure or Detention
If goods are detained, seized, confiscated or otherwise affected by customs or another governmental authority, East Gate will not be responsible for the resulting loss where the action occurs outside East Gate's reasonable control.
The Customer remains responsible for applicable duties, taxes, penalties, storage fees, examination fees and other charges where applicable.
East Gate may assist with communication or documentation where reasonably possible but does not guarantee release of detained or seized goods.
20Storage After Goods Are Ready
Once goods are received in Jamaica and are ready for collection or delivery, the Customer is responsible for collecting or arranging collection within 14 days.
The first 14 days after goods become ready for collection are allotted to the Customer without the additional daily storage charge described below.
After the 14-day period expires, a storage fee of JMD $100 per day will apply.
The storage fee will continue to accrue for each day the goods remain uncollected.
The Customer remains responsible for all applicable storage charges regardless of whether the Customer has personally visited the facility, provided that reasonable notice of the goods being ready has been communicated through the contact information provided by the Customer.
21Uncollected and Abandoned Goods
If goods remain uncollected for 30 days after becoming ready for collection and the Customer has failed to maintain communication with East Gate, the goods may be treated as abandoned.
Where permitted by applicable law and after any legally required notice or procedure, East Gate may sell, auction, dispose of or otherwise deal with the goods for the purpose of recovering amounts owed in connection with the shipment.
This may include customs duties, taxes, clearance expenses, freight charges, storage charges, handling charges, administrative expenses and other reasonable expenses incurred by East Gate in connection with the goods.
Where proceeds from the sale or auction are insufficient to cover amounts lawfully owed, the Customer may remain responsible for the outstanding balance to the extent permitted by law.
22Loss or Damage
East Gate will take reasonable steps to coordinate the handling and forwarding of Customer goods.
However, goods may be handled by suppliers, manufacturers, warehouses, freight companies, airlines, shipping lines, customs authorities, port operators, delivery companies and other third parties.
To the extent permitted by applicable law, East Gate is not responsible for loss, theft, damage, shortage or deterioration caused by a third party or by circumstances outside East Gate's reasonable control.
Where a responsible third party provides a claims process, East Gate may assist the Customer in pursuing the applicable claim.
23Insurance
Insurance is not automatically included in East Gate's services.
Where insurance is available and specifically purchased by the Customer, the insurance will be subject to the insurer's own terms, conditions, exclusions, limits, deductibles and claims procedures.
East Gate does not guarantee that an insurance claim will be approved or paid.
24Customer-Supplied Specifications
The Customer is solely responsible for providing accurate specifications and instructions.
This includes product links, images, sizes, measurements, colours, materials, quantities, logos, branding, packaging, designs, technical requirements and other product instructions.
East Gate is not responsible for losses resulting from inaccurate, incomplete, ambiguous or outdated Customer instructions.
25Customization and Logos
Where goods are customized with a Customer's logo, branding, design or other intellectual property, the Customer is responsible for ensuring that they have the necessary rights or authorization to use that material.
The Customer acknowledges that customized goods may be subject to additional production time, minimum quantities, supplier requirements and additional costs.
Once customization or production has commenced, cancellation or modification may not be possible.
26Intellectual Property and Counterfeit Goods
East Gate does not knowingly authorize the sourcing or shipment of counterfeit goods.
The Customer is responsible for ensuring that any logo, trademark, design, image, branding or other intellectual property supplied to East Gate does not infringe the rights of another person or entity.
The Customer agrees to be responsible for claims arising from intellectual-property material supplied or requested by the Customer, to the extent permitted by law.
27Cancellation
Once East Gate has commenced sourcing work, contacted suppliers, placed an order, made supplier payments, commenced production or otherwise committed funds or resources to the transaction, cancellation may not be possible.
Where cancellation is accepted, the Customer remains responsible for all applicable non-refundable amounts, including the sourcing fee, supplier deposits, supplier cancellation charges, production costs, payment-processing charges, bank fees, shipping charges, administrative expenses and other third-party costs incurred on the Customer's behalf.
28Payment Default
If the Customer fails to make a required payment by the applicable deadline, East Gate may suspend or stop services associated with the transaction.
East Gate may also withhold goods from release, forwarding or delivery until outstanding amounts have been paid, subject to applicable law.
Additional storage, supplier, shipping or administrative costs resulting from payment default remain the Customer's responsibility.
29Limitation of Liability
To the maximum extent permitted by applicable law, East Gate shall not be responsible for indirect, incidental, consequential, special or punitive losses arising from a transaction, including loss of anticipated profits, loss of sales, loss of business opportunity, business interruption, loss of expected investment returns or other consequential commercial losses.
East Gate is not responsible for losses caused by third-party suppliers, manufacturers, carriers, shipping companies, airlines, customs authorities, ports, warehouses or other independent service providers where such losses are outside East Gate's reasonable control.
Where East Gate is legally determined to be responsible for a loss, its liability shall, to the maximum extent permitted by applicable law, be limited to the amount actually paid to East Gate for the specific service giving rise to the claim, excluding amounts paid to third parties on the Customer's behalf.
30Customer Indemnification
To the extent permitted by law, the Customer agrees to indemnify and hold harmless East Gate, its owners, employees, agents and representatives against claims, losses, penalties, costs and reasonable expenses arising from:
- Incorrect information supplied by the Customer;

- Intellectual-property claims arising from Customer-provided material;
- Failure to pay customs duties or taxes;
- Customer instructions;
- Customer breach of these Terms;
- Customer's unauthorized use or resale of goods; or
- Other acts or omissions by the Customer that cause liability to East Gate.
This provision does not require the Customer to indemnify East Gate for liability that cannot legally be transferred to the Customer.
31Force Majeure
East Gate shall not be responsible for failure or delay caused by circumstances outside its reasonable control.
Such circumstances may include hurricanes, floods, earthquakes, fires, natural disasters, epidemics or pandemics, war, civil unrest, government action, customs restrictions, port closures, strikes, labour disputes, transportation disruptions, airline disruptions, shipping-line disruptions, supplier disruptions, security incidents, cyber incidents, or other extraordinary circumstances outside East Gate's reasonable control.
East Gate will make reasonable efforts to resume affected services when circumstances permit.
32Third-Party Service Providers
East Gate may use independent third parties to perform aspects of a transaction.
These may include suppliers, manufacturers, freight companies, airlines, shipping lines, customs brokers, warehouses, delivery companies, payment processors and other service providers.
Third-party services may be subject to separate terms and conditions.
East Gate does not control the independent operations, decisions or policies of such third parties.
33Communication
Customers are responsible for providing accurate and current contact information.
East Gate may communicate with Customers through email, telephone, WhatsApp, SMS, social media, customer portals or other contact information provided by the Customer.
The Customer is responsible for monitoring communications relating to orders, payments, shipping, customs, collection, storage, claims and other matters relating to their transaction.

These Terms, together with any applicable quotation, invoice, order confirmation or specific written agreement issued by East Gate for a particular transaction, constitute the agreement governing the Customer's use of East Gate's services.
Any specific written terms communicated for a particular transaction will apply only to that transaction unless expressly stated otherwise.
No verbal statement, representation or promise made by an unauthorized person shall modify these Terms.
39Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permissible.
The remaining provisions shall continue in full force and effect.
40No Waiver
East Gate's failure or delay in enforcing any provision of these Terms shall not constitute a waiver of its right to enforce that provision at a later time.
